Does the plan’s compensation definition need to be complicated? No. Do plan sponsors like to make it complicated? Maybe. This session will help you understand why the compensation definition is important to all facets of plan administration. Can a plan have different definitions for contribution limits, allocation purposes and testing? Yes. Would you want to do that? Never. Will a plan sponsor ask you if it’s possible? Likely. Be ready to answer the plan sponsor’s questions along with understanding exclusions and post-severance compensation.

10:20AM - Fiduciary Committee Best Practices
Are you or your client acting with the care, skill, prudence, and diligence under the circumstances then prevailing that a prudent person acting in a like capacity and familiar with such retirement plan matters would use? This is a pretty high standard. For retirement plan sponsors, how do they comply with necessary requirements? Are there ways to delegate obligations to internal committees or outside third parties? What does that delegation require and how does it mitigate fiduciary liability? We'll tackle these questions to ensure this high standard is achieved by all retirement plan fiduciaries.

The dreaded letter or call no one wants. But it doesn’t have to be that scary. Whether you are proactively assisting a client in administering its plan or have been asked to help in the audit or investigation, there are strategies to either avoid or mitigate them. We will explain the initiation and process of IRS audits and DOL investigations, identify focus areas targeted by the IRS and DOL, and describe methods or steps in reducing the chances or lessening the impact of an audit or investigation.

Client approaches you with a plan issue. Can that be fixed through SCP, VCP, other? Are you taking full advantage of the IRS correction programs? Be able to identify which issues can be fixed through EPCRS, how to correct them, and also spot red flags before issues pop up. The presentation will cover some of the lesser known aspects of the programs which you may have forgotten or were unaware. In addition, we will walk through a VCP submission under the new guidelines.

If can feel like the wild west when dealing with plan expenses. They come in all different varieties under two categories, plan or settlor expenses. Which is which and why does it matter? This session will identify the categories and help you understand why it is important to get it right.

Both the IRS and DOL have released guidance on the importance for both plan sponsors and service-providers to take proactive measures and include plan-related information in their cybersecurity risk management programs. We will cover the latest developments in this rapidly-evolving area and explore action items you can take to protect client data.
12:10PM - Controlled Groups
Controlled groups are a complex component for retirement plan desgin. Who owns what? When does that matter? Does family attribution have an impact? How do you treat multiple plans in a related group of employers? We will look at several case studies of real life and hypothetical scenarios surround the determination and implementation of controlled groups.

Brian Furgala is the Registrar for this course and will keep attendance records in the event your credits need to be verified.
For certification with ERPA credit: If you are receiving ERPA Credit you will not download the certificate at the end of the survey and instead one will be emailed to you.
